    Default Credit Card Lawsuits

    I have credit card debt of about $8,000 spread over 5 cards that are totally maxed out. About $7,000 is merely finance fees, over limit fees, interest and the rest of the stuff the Credit Card Act of 2009 deals with.

    Two of the cards I have actually paid more than $300 on each cards,in payments in excess of amount of purchases, yet my balances on both is $1,200 and $1,100. Yes, I have paid for more than everything I acually bought. yet have four digit balances. A fourth I also have paid for everything, yet have a balance of $1,400

    I have just been sued by one of them for $1,200 for which I have at most $150 of unpaid purchases. The rest is CCA 2009 stuff. The answer has to be filed within 23 days. I got it Wednesday and already recieved five direct mail pieces from law firms wanting to represent me.

    I would like to know what sort of defenses can be available. I am presently insolvent, typing this on someone else's computer, with no employment but spending about 6 hours a day, or more, looking for a job and trying to get a business going.

    I would like to know any type of delay motions I can file until I can pay off the card(s). I know to file an answer and not have a default judgement. I am fully aware of bankruptcy but would like to not file.

    Try and negotiate your credit card debt. You can do it yourself you dont need no blood sucking lawyer or scam service to do it for you. They cant do anything to you with unsecured debt like this besides trashing your credit record.

    Yes, talk to the bank to help you with this issue. They will be giving some considerations on how you can be able to pay your debts without even consulting a lawyer. Credit cards can help you during emergency but beware of spending too much and pay on time.

    I essentially agree with AnthonyBarone. But they can garnish wages and that is not something you want if you do get a new job. Plus if you are starting a business you do not want bad credit.

    Do what Mr. Barone says and try to negotiate with them to save your credit. Maybe contact a non-profit credit couseling service...not the blood suckers who are contacting you. Or contact "legal aid" in your area for a referral.

    There is another forum...getrichslowly.org that has a lot of people that might be able to help you with your question because they have been through it.
