I have credit card debt of about $8,000 spread over 5 cards that are totally maxed out. About $7,000 is merely finance fees, over limit fees, interest and the rest of the stuff the Credit Card Act of 2009 deals with.
Two of the cards I have actually paid more than $300 on each cards,in payments in excess of amount of purchases, yet my balances on both is $1,200 and $1,100. Yes, I have paid for more than everything I acually bought. yet have four digit balances. A fourth I also have paid for everything, yet have a balance of $1,400
I have just been sued by one of them for $1,200 for which I have at most $150 of unpaid purchases. The rest is CCA 2009 stuff. The answer has to be filed within 23 days. I got it Wednesday and already recieved five direct mail pieces from law firms wanting to represent me.
I would like to know what sort of defenses can be available. I am presently insolvent, typing this on someone else's computer, with no employment but spending about 6 hours a day, or more, looking for a job and trying to get a business going.
I would like to know any type of delay motions I can file until I can pay off the card(s). I know to file an answer and not have a default judgement. I am fully aware of bankruptcy but would like to not file.
